ARM, Anglo to test Modikwa ruling

JOHANNESBURG, Feb 20 – African Rainbow Minerals and joint venture partner Anglo American Platinum plan to challenge the award of a mining right to Nkwe Platinum over the Modikwa Deeps properties in South Africa’s Bushveld Complex.
ARM and Amplats have mounted a legal challenge over the prospecting rights to portions of the Garatau, DeKom and Hoepakrantz farms.
While Nkwe claims the award of the mining right confirms its legal tenure of the farms, ARM and Amplats say no agreement has been reached in negotiations that included South Africa’s Mineral Resources Department.
They say they are willing to continue negotiations in an attempt to resolve the situation, but the litigation will also continue and will include a challenge to the issue of the mining right.
